10.3 Class Action Waiver

YOU AND CHUYS GRILL AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any form of a representative or class proceeding.

10.4 Exceptions to Arbitration

Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent actual or threatened infringement of intellectual property rights, misappropriation of trade secrets, breach of confidentiality obligations, or other immediate irreparable harm. Such a request shall not be deemed a waiver of the right to arbitrate.

10.5 Consumer Protection Rights

Nothing in these Terms is intended to limit any rights you may have under applicable consumer protection laws, including the Federal Trade Commission Act (15 U.S.C. § 41 et seq.) or any applicable state consumer protection statutes. 11. Term and Termination

In the event of such circumstances, we will make commercially reasonable efforts to resume normal operations as quickly as practicable.
